Real Estate Transactions

In the world of real estate, several kinds of transactions require different kinds of paperwork. The types of common real estate transactions and necessary documentation that Attorney Hendrix can help you with include but are not limited to:

  • Deeds – A deed is required to convey or transfer property (with some exceptions). The deed shows who has conveyed the property (Grantor) and who has received the property (Grantee) – this is the legal owner of the property. Importantly, the deed must also include a proper legal description of the property in order to be effective.
  • Purchasing contracts – While a deed establishes ownership of a property, a purchasing contract lays out the terms of the purchase of the property, including Purchase price, legal description of the property, terms of payment, whether a survey is required, whether a title company will be utilized, and may other terms.
  • Promissory notes – If a seller decides to “Seller finance” or “Owner finance”, a promissory note is needed to reflect the terms of the loan. If you are borrowing from a third party (bank, mortgage company, etc.), a promissory note is generated to reflect the terms of the loan such as the amount of the loan (amount owed), the payment schedule (monthly, annually, etc.), the interest rate on the loan, and the maturity date (date the loan must be paid off).
  • Deeds of trust – A deed of trust is an important legal that establishes the rights of the parties to a transaction where a lender is involved. This document provides the lender with a security interest in the property being sold or purchased and outlines the rights of the borrower and the lender.
